Terms of Service

Read the terms and conditions governing the use of the SmartCheck app.

These Terms of Service (“Terms”) govern your access to and use of the SmartCheck mobile application, website, and related services (collectively, the “Service”). SmartCheck (“SmartCheck”, “we”, “us”, “our”) provides a tool to create and manage shared expense tables (“Tables”), including adding participants, uploading receipts, and splitting items collaboratively.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, signing in, or using any part of the Service, you confirm that:

  • You have read and understood these Terms; and
  • You agree to be bound by them.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

SmartCheck is an informational and collaboration tool that helps users:

  • Create and manage Tables for shared expenses;
  • Add and manage participants;
  • Add items, quantities, prices, taxes/tips, and assignments;
  • Upload receipt images to support table creation and reference;
  • Collaborate in real time (e.g., join/leave, assign/unassign, statuses, close/reopen).

Important: SmartCheck is not a bank, payment processor, escrow service, or debt collection service. We do not move money between users. Any payments, reimbursements, or settlements happen outside SmartCheck and are your responsibility.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.

You may not use the Service if:

  • You are prohibited from using it under applicable law; or
  • Your account has been suspended or terminated by us.

4. Accounts and Authentication

To use certain features, you must create an account and sign in. SmartCheck currently supports authentication via Google Sign-In (and may support other methods such as email/password).

You agree to:

  • Provide accurate account information;
  • Keep your account secure and not share access with others;
  • Promptly notify us if you suspect unauthorized access.

You are responsible for all activity that occurs under your account.

5. User Responsibilities

You are responsible for how you use SmartCheck and for the accuracy of the information you enter or upload.

You agree not to:

  • Use the Service for illegal, harmful, or abusive purposes;
  • Upload content that infringes others’ rights (privacy, copyright, trademark, etc.);
  • Upload malicious code, attempt to exploit or disrupt the Service, or reverse engineer where prohibited by law;
  • Harass, impersonate, or threaten others;
  • Use the Service to store or share highly sensitive personal data you do not have a right to share.

Accuracy of calculations: SmartCheck provides automated calculations and splits based on the data users input. You are responsible for reviewing results before relying on them. Differences can occur due to user input errors, rounding, taxes/tips, receipt quality, extraction limitations, or participant changes.

6. Shared Content & Collaboration

SmartCheck is designed for shared Tables among multiple users. When you create or join a Table, you understand that:

  • Other participants may be able to view and interact with Table content you or others add (items, assignments, receipt images, table history, and participant actions).
  • Participants may export, copy, screenshot, or otherwise retain content visible to them. SmartCheck cannot control what other participants do with content after they access it.

User-Generated Content

“User Content” includes content you create, upload, or submit through the Service (such as Table data, item text, and receipt images).

You retain ownership of your User Content, but you grant SmartCheck a limited license to host, store, process, reproduce, and display it solely to operate and improve the Service (for example, to sync Tables, show receipts, or extract items from receipt images).

You represent that you have the necessary rights to upload and share your User Content, including receipt images.

Disputes Between Users

SmartCheck does not mediate disputes between participants (for example, disagreements about who owes what, whether an item is correct, or how a receipt should be split). You are responsible for resolving disputes directly with other participants.

7. Account Deletion & Data Handling

Our approach to deletion is designed to respect privacy while preserving shared Table history for other participants, consistent with our Privacy Policy.

When you delete your account:

  • Your account is disabled and you can no longer sign in.
  • We delete or anonymize personal profile data (such as name, email, phone number, profile photo), as described in our Privacy Policy.
  • Shared Tables, items, action history, and receipt images may remain available to other participants in those Tables.
  • In shared records, you may appear as an anonymous/deleted user (for example, “Deleted User”) to preserve the integrity of the shared table history.

Backups and technical retention

Deleted data may persist temporarily in routine backups or logs until rotated or overwritten, as described in our Privacy Policy.

Relationship to Privacy Policy

Your use of the Service is also governed by our Privacy Policy (Last updated: 2026-02-20). If these Terms and the Privacy Policy conflict regarding privacy/data handling, the Privacy Policy controls for those topics.

8. Intellectual Property

The Service (including the app, backend, code, design, logos, trademarks, and all non-user content) is owned by SmartCheck or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless permitted by law or we give written permission.

Feedback: If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.

9. Disclaimer of Warranties

SmartCheck is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

We do not guarantee that:

  • The Service will always be available, uninterrupted, secure, or error-free;
  • Calculations, receipt extraction results, or table data will always be accurate or complete;
  • Data will never be lost.

No financial advice: SmartCheck is an informational tool. We do not provide financial, accounting, tax, or legal advice. You are responsible for decisions you make based on the Service.

10. Limitation of Liability

To the fullest extent permitted by law, SmartCheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption arising out of or related to your use of the Service.

To the fullest extent permitted by law, SmartCheck’s total liability for any claim related to the Service will not exceed the greater of:

  • The amount you paid to use the Service in the 12 months before the event giving rise to the claim (if any); or
  • $50 USD (or the equivalent in your local currency).

This limitation applies even if we were advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless SmartCheck (and its founders, contractors, and service providers) from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service;
  • Your User Content (including receipt images) and any allegation it infringes someone else’s rights;
  • Your violation of these Terms; or
  • Disputes between you and other users.

12. Termination

You may stop using the Service at any time and may delete your account as described above.

We may suspend or terminate your access to the Service (including your account) if we reasonably believe you:

  • Violated these Terms;
  • Misused the Service or harmed other users;
  • Used the Service in a way that creates legal risk for SmartCheck; or
  • Attempted to compromise the security or integrity of the Service.

Where reasonable, we may provide notice, but we may act immediately to protect users, the Service, or legal compliance.

Termination does not affect:

  • Shared Table history retained for other users as described in Section 7; and
  • Sections of these Terms that by nature should survive (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law).

13. Changes to the Terms

We may update these Terms from time to time. We will update the “Last updated” date at the top.

If changes are significant, we may provide additional notice (for example, in-app notice or on our website). Your continued use of the Service after changes become effective means you accept the updated Terms.

14. Governing Law

Because SmartCheck is operated from Mexico, these Terms are governed by the laws of Mexico, without regard to conflict of law principles.

Practical approach for a small startup: If a dispute arises, you agree to first contact us and attempt to resolve it informally. If unresolved, disputes will be handled in the competent courts of Mexico (typically the jurisdiction where the operator is established), unless mandatory consumer protection laws in your country require otherwise.
