Last updated: February 21, 2026These Terms of Service (“Terms”) govern your access to and use of the SmartCheck mobile application, website, and related services (collectively, the “Service”). SmartCheck (“SmartCheck”, “we”, “us”, “our”) provides a tool to create and manage shared expense tables (“Tables”), including adding participants, uploading receipts, and splitting items collaboratively.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
By creating an account, signing in, or using any part of the Service, you confirm that:

SmartCheck is an informational and collaboration tool that helps users:
Important: SmartCheck is not a bank, payment processor, escrow service, or debt collection service. We do not move money between users. Any payments, reimbursements, or settlements happen outside SmartCheck and are your responsibility.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
You may not use the Service if:
To use certain features, you must create an account and sign in. SmartCheck currently supports authentication via Google Sign-In (and may support other methods such as email/password).

You are responsible for all activity that occurs under your account.
You are responsible for how you use SmartCheck and for the accuracy of the information you enter or upload.

Accuracy of calculations: SmartCheck provides automated calculations and splits based on the data users input. You are responsible for reviewing results before relying on them. Differences can occur due to user input errors, rounding, taxes/tips, receipt quality, extraction limitations, or participant changes.
SmartCheck is designed for shared Tables among multiple users. When you create or join a Table, you understand that:
“User Content” includes content you create, upload, or submit through the Service (such as Table data, item text, and receipt images).
You retain ownership of your User Content, but you grant SmartCheck a limited license to host, store, process, reproduce, and display it solely to operate and improve the Service (for example, to sync Tables, show receipts, or extract items from receipt images).
You represent that you have the necessary rights to upload and share your User Content, including receipt images.
SmartCheck does not mediate disputes between participants (for example, disagreements about who owes what, whether an item is correct, or how a receipt should be split). You are responsible for resolving disputes directly with other participants.
Our approach to deletion is designed to respect privacy while preserving shared Table history for other participants, consistent with our Privacy Policy.

Deleted data may persist temporarily in routine backups or logs until rotated or overwritten, as described in our Privacy Policy.
Your use of the Service is also governed by our Privacy Policy (Last updated: 2026-02-20). If these Terms and the Privacy Policy conflict regarding privacy/data handling, the Privacy Policy controls for those topics.
The Service (including the app, backend, code, design, logos, trademarks, and all non-user content) is owned by SmartCheck or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless permitted by law or we give written permission.
Feedback: If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
SmartCheck is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
We do not guarantee that:
No financial advice: SmartCheck is an informational tool. We do not provide financial, accounting, tax, or legal advice. You are responsible for decisions you make based on the Service.
To the fullest extent permitted by law, SmartCheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption arising out of or related to your use of the Service.
To the fullest extent permitted by law, SmartCheck’s total liability for any claim related to the Service will not exceed the greater of:

You agree to indemnify and hold harmless SmartCheck (and its founders, contractors, and service providers) from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
You may stop using the Service at any time and may delete your account as described above.
We may suspend or terminate your access to the Service (including your account) if we reasonably believe you:
Where reasonable, we may provide notice, but we may act immediately to protect users, the Service, or legal compliance.
Termination does not affect:
We may update these Terms from time to time. We will update the “Last updated” date at the top.
If changes are significant, we may provide additional notice (for example, in-app notice or on our website). Your continued use of the Service after changes become effective means you accept the updated Terms.
Because SmartCheck is operated from Mexico, these Terms are governed by the laws of Mexico, without regard to conflict of law principles.
Practical approach for a small startup: If a dispute arises, you agree to first contact us and attempt to resolve it informally. If unresolved, disputes will be handled in the competent courts of Mexico (typically the jurisdiction where the operator is established), unless mandatory consumer protection laws in your country require otherwise.
